Terms of use

These General Terms of Use (hereinafter "GTU") govern access to and use of the BotSEO platform, accessible at www.botseo.fr (hereinafter "the Platform"), published by OPTI CONSULT (SASU, SIREN 945 128 494, 27 Rue Raymond Aron, 33400 TALENCE).

BotSEO is a SaaS platform for SEO and GEO optimization powered by artificial intelligence, allowing users to analyze their websites, generate content strategies and optimize their organic search performance and their visibility in generative search engines.

Any use of the Platform implies full and unreserved acceptance of these GTU. If you do not accept these terms, please do not use the Platform.

Access to BotSEO requires:

• A recent web browser (Chrome, Firefox, Safari, Edge).
• A stable internet connection.
• The creation of a user account (e-mail plus password, or Google sign-in).

A free plan is available with limited features. Paid plans (Starter, Pro) offer extended capacities.

We reserve the right to modify, suspend or discontinue all or part of the service, in particular for maintenance reasons, with reasonable prior notice except in an emergency.

You are responsible for keeping your login credentials confidential. Any activity carried out from your account is deemed attributable to you.

By creating an account, you warrant that you:

• Are a natural person of legal age or a duly authorized legal entity.
• Provide accurate and up-to-date information.
• Do not create several accounts in order to circumvent plan limits.
• Inform BotSEO immediately in the event of unauthorized access to your account.

Paid subscriptions are billed monthly or annually depending on the plan chosen. Payment is processed securely by Stripe.

• Automatic renewal: subscriptions renew automatically at the due date, unless cancelled beforehand.
• Plan change: you may move to a higher plan at any time. The change takes effect immediately.
• Cancellation: you may cancel from your "Billing" area. Access to the paid plan remains active until the end of the current period.
• Refund: no partial refund is granted for a period already started, except in the event of a proven malfunction on our part.

The prices displayed are in euros, all taxes included. We reserve the right to change our prices with 30 days' prior notice.

Each plan includes a monthly credit quota. Credits are consumed when using the AI agents (sending messages, analyses, content generation).

• Exceeding the quota results in the temporary suspension of the AI features until the next renewal.
• Credits are reset at each monthly renewal.
• Credits not used by the end of the month are not carried over.

All the elements making up the Platform (source code, design, trademark, texts, algorithms) are the exclusive property of the publisher of BotSEO and are protected by intellectual property law.

The content generated by the AI agents from your requests belongs to you. You retain full ownership of your data, projects and content created on the Platform.

It is strictly forbidden to use BotSEO to:

• Use the service for unlawful purposes or purposes contrary to public order.
• Resell access to the Platform or to its features to third parties without authorization.
• Use automated scripts to overload our servers (mass scraping, bots).
• Access other users' data without authorization.
• Attempt to circumvent the security measures of the Platform.
• Generate unlawful, misleading or defamatory content, or content infringing third-party rights.

Any breach of these rules may result in the immediate suspension or termination of the account, without refund.

BotSEO is an assistance tool. The recommendations generated by the AI agents are provided for information purposes and do not constitute guaranteed professional advice.

To the extent permitted by law, we disclaim all liability for:

• The SEO results obtained or not obtained following use of the Platform.
• Loss of data resulting from a use that does not comply with these GTU.
• Service interruptions beyond our control (third-party API failures, force majeure).
• Decisions taken on the basis of the AI recommendations.

Our contractual liability is limited to the amount of the sums paid by the user over the 3 months preceding the damage.

By the user: you may terminate your account at any time from My account, then Delete my account. This action is irreversible and results in the definitive deletion of all your data within 30 days.

By BotSEO: we reserve the right to suspend or terminate an account in the event of a breach of these GTU, of non-payment or of abusive behaviour, after notification (except in serious cases justifying immediate suspension).

Anti-fraud measures after deletion: in order to prevent abuse of the Free plan (repeated creation of accounts in order to accumulate the credits offered), BotSEO keeps, for a maximum period of 60 days after the deletion of an account, the following items: e-mail address of the deleted account and list of the domains of the associated projects. During this period:

• the creation of a new account with the same e-mail address is allowed but will not give entitlement to the free credits offered on sign-up;
• the creation of a project with a domain that belonged to the deleted account is temporarily blocked. For the legitimate owners of these sites, a reactivation procedure is available from support at contact@botseo.fr.

At the end of these 60 days, this data is automatically deleted and any restriction is lifted. This measure is implemented on the basis of the legitimate interest of BotSEO in protecting its resources against fraud (article 6.1.f of the GDPR).

We may modify these GTU at any time. In the event of a substantial change, you will be informed by e-mail or through a notification on the Platform, at least 15 days before the new terms come into force.

These GTU are governed by French law. In the event of a dispute, the parties undertake to seek an amicable solution before any legal action.

Failing an amicable agreement, any dispute relating to the interpretation or performance of these GTU shall be submitted to the exclusive jurisdiction of the courts within the jurisdiction of Bordeaux.
